Speaking to the court on Monday, prosecutors said they would provide new evidence that the findings of the 1967 investigation – no one was responsible for Lutuli’s death crime – were not based on facts and evidence and were “to ensure that the perpetrators remain hidden and protected.”

The prosecutor asserted that “there was a collusion between the security police, the district surgeon, the pathologist, the prosecutor and the magistrate.”

Luthuli’s family and others have long questioned the findings and called for an independent investigation.

His grandson, Sandile Luthuli, told South Africa’s public broadcaster that Luthuli’s two surviving daughters are 90 and 93, and are relieved to see the reopening of the investigation.

“It’s been 57 years,” Lutuli said.

The prosecution agency attempted to overturn previous findings of Luthuli and Mxenge.

“Our system now allows a restart of the investigation and we believe the Luthuli and Mxenge families will find the shutdown,” said ANC spokesman Mahleni Bhengu-Motsiri.
