Quebec Judge Rule 2 Should Face Our Repatriation in Human Smuggling River Death

A judge in the Quebec High Court ruled that two people from Akvisas should face extradition to the United States, where they face charges related to human smuggling, ended in a drowning death of nine people on March 29, 2023.

Judge Gregory Moore said the federal royal family provided sufficient evidence to meet the low standards of evidence at this stage of the extradition process.

“It’s a very limited role, and it’s just intended to decide whether there are superficial cases and whether there have been … crimes,” Moore said.

“The extradition judge did not hear the trial, and the judge intended to make a quick process, [deciding] Only whether a trial should be conducted. ”

The federal attorney general will ultimately decide to extradite.

Stephanie Square and Rahsontanohstha Delormier both want to enter the United States to face an indictment filed in the upstate New York federal court linked to a drowning death from a family of four from India and a Romanian-Canada family of four.

Although the so-called square and tragedy have a very different role in tragedy, their case has been heard together in this stage of the extradition process.

Romanian citizen Florian Iordache, Cristina Iordache and two Canadian-born children, Evelin and Elyen, 2, 16 months, drowned on March 29, 2023, when they were spinning in stormy weather in the storm of the St. Lawrence River.

They shared the ship with a family of four from India, father Pravindbhai Chaudhari, mother of Dakshaben Chaudhari and their two adult children, son Mitkumar and daughter Vidhiben. The ship was launched from Cornwall Island and headed to the south shore of St. Lawrence, but never did.

Between March 30 and 31, the bodies of two families were pulled out of the river.

In July, the body of Casey Oakes was found among the tillers on board.

Akwesanse is a Haudensaunee community cut off by the Canadian-US border. It is located about 120 kilometers west of Montreal, and its territory is divided into Ontario, Quebec and New York.

The Chaudhari family in Canada paid $100,000 on visitor visas, and the Iordaches, facing deportation, paid about $15,000 to a human smuggling network allegedly led by a Montrealist named Thesingarasan Rasiah. Both families want to enter the United States

The RCMP accused Rasiah of detained in June 2024, with many charges related to human smuggling.

To the Minister

Now, the case is determined before the federal attorney general whether it should surrender to the U.S. Square, and Delormier has 30 days to apply for temporary release and appeal. They can also submit to the Minister.

The Canadian Court of Appeal and Supreme Court level can also be challenged against the minister’s extradition ruling.

Square’s Montreal attorney Joel Girard said they would appeal directly to the federal attorney general through a letter that he should refuse an extradition request. Girard questioned whether the United States has any jurisdiction to file criminal charges against dead people on the river because they occur within Canadian territory.

“In Canada, suspected crimes should be prosecuted in Canada,” Gillard said.

Delormier’s Montreal attorney Antonio Cabral said he plans to apply for Delormier’s temporary release. Cabral said he also plans to appeal Moore’s decision and seek a Gladue report for Delormier. Girard said he would also seek to send a Square Gladue report to the minister.

The Gladue report basically just like the pre-verdict report, including the historical impact of deprivation and colonialism on the lives of indigenous criminals. However, there is case law regarding the use of Gladue reports during extradition.

Cabral said he plans to “use all my strength and energy to deal with Demir’s extradition”.

The Plaza faces eight counts in the indictment, including alien smuggling, conspiracy to commit alien smuggling, foreign smuggling profits, and four counts of alien smuggling, causing death to each of the Romanian-Canadian families.

Delormier faces five charges, including conspiracy to commit alien smuggling, alien smuggling and alien smuggling for profit.

According to public records, most of the U.S. cases against Delormier and Square are based on evidence collected by Canadian authorities. The square is the alleged run organizer who allegedly hired Casey Oakes to bring the two families across the river.

On March 30, Delormier was found on an island on the verge of hypothermia. Extradition files alleged that he was driving a ship purchased by the square that collapsed on his way to Cornwall Island and his family was waiting to smuggle.
