German Supreme Court ruled Apple market dominance
The German Federal Court (BGH) aims to rule whether Apple has a great significance across the market on Tuesday, a classification that could give the company more stringent competitive controls.
The U.S. company is proposing a decision from the German Federal Cartel Office that 2023 has “noticeable, cross-market significance.”
If the Karlsruhe-based court sticks with the evaluation of competition regulators, Apple will face stricter monitoring of market abuse.
BGH ruled that Apple’s appeal was the first and only instance of the case.
Since the law changes in 2021, German regulators have been able to take action against large digital companies more easily.
The process consists of two steps. First, authorities determine whether a company has a significant influence in the market regardless of the specific violation. If this is confirmed, practices that it considers harmful to competition can be prohibited.
