Jury ruling $48.1 million in malfeasance case against Mercy Hospital
Stone. Louis-St. Louis County jury ruled a $48.1 million verdict to Simon’s law firm in a lawsuit against Mercy Hospital.
The verdict, filed on March 25, involved a case of malfeasance, which was permanently damaged in the brain after doctors insisted that the baby’s mother continued to push for 12 hours.
The mother, born on May 3, 2020, is also Mercy’s heart nurse. The lawsuit claims there are warning signs that the child is troubled.

Before the baby boy was 24 hours old, he had epilepsy and stayed in NICU for 46 days. The mother is now a full-time caretaker to her son and does not work for mercy.
In the judgment, approximately $28.1 million in compensatory damages and $20 million in punitive damages were imposed on Mercy Hospital, Mercy Clinic and Dr. Daniel McNeive.
After the verdict, Simon Law Firm celebrated the announcement in a social media post on Facebook.
“After working with this family for four years, I’m glad I’ve been given justice in this case,” said Simon law attorney Liz Lenivy. “We’re glad the jury spent a lot of time and caring for the evidence and a fair result.”
The trial lasted about three weeks.
